Terms of Service



These Terms of Service (“Terms”) govern your use of this website and any purchases made from Romford Fencing Ltd (“we”, “us”, “our”). By accessing our website or placing an order, you agree to these Terms, our Returns Policy, and our Privacy Policy, all of which form part of the contract between us.





1. Customer Type (B2C and B2B)



Orders may be classified as:


  • Consumer (B2C): Individuals purchasing for personal, non-commercial use
  • Business / Trade (B2B): Purchases made wholly or mainly for commercial purposes



We reserve the right to classify orders based on order quantity, delivery address, product type, or information provided at checkout.





2. Products & Descriptions



All fencing materials (including fence panels, posts, gravel boards, rails, gates, fixings, and timber products):


  • Are natural products and may vary in colour, grain, texture, or finish
  • May vary slightly in size within industry-accepted tolerances
  • Are shown in images for illustrative purposes only



Such variations do not constitute defects and do not qualify for return under our Returns Policy.





3. Orders & Contract Formation



  • All orders are subject to availability and acceptance
  • Order confirmation does not constitute acceptance
  • A binding contract is formed only once goods are dispatched



We reserve the right to refuse or cancel orders due to pricing errors, stock issues, or suspected misuse.





4. Pricing & Payment



  • Prices are shown in GBP and include VAT where applicable
  • Delivery charges are shown at checkout
  • Payment must be received in full prior to dispatch unless expressly agreed otherwise



Additional terms apply to Cash on Delivery and Bank Deposit orders.





5. Delivery, Access & Kerbside Delivery




Kerbside Delivery (Standard)



All fencing materials are delivered on a kerbside delivery basis only, unless otherwise agreed in writing prior to dispatch.


Kerbside delivery means:


  • Delivery to the nearest safe and legally accessible point, typically at the public highway or kerb
  • Drivers are not required to move goods beyond the kerbside
  • Goods will not be carried into gardens, driveways, buildings, or rear access areas



Customers are responsible for moving goods from the kerbside after delivery.



Access Requirements



Customers must ensure:


  • Clear, safe, and suitable access for delivery vehicles
  • That the delivery location can safely support the weight of delivery vehicles and equipment
  • That vehicles can lawfully stop at or near the delivery address



If access is unsuitable, delivery may be refused or rearranged, and additional charges may apply.





6. HIAB, Pallet & Crane Offload Deliveries



Where delivery involves HIAB, crane, pallet, or mechanical offload equipment:


  • Offloading is carried out at the driver’s sole discretion based on safety conditions
  • The driver may refuse to operate equipment if ground conditions, access, overhead obstructions, or safety risks are present
  • Offload will only take place to a safe, level, and accessible area



We do not guarantee placement beyond the kerbside, even where mechanical offload is used.





7. Inspection & Reporting Issues



All customers must inspect goods upon delivery.


  • Damage, shortages, or incorrect items must be reported within 48 hours of delivery
  • Claims must be supported with photographic evidence
  • Claims made outside this timeframe may be rejected



This clause operates alongside our Returns Policy.





8. Property Damage



We are not responsible for damage to driveways, paths, paving, kerbs, walls, lawns, underground services, or other surfaces or structures where damage results from:


  • Restricted or unsuitable access
  • Fragile, uneven, or weak ground conditions
  • Customer instructions to leave goods in a specific location
  • Pre-existing damage or defects



Nothing in these Terms excludes or limits liability for damage caused by our negligence where such liability cannot be excluded under UK law.





9. Risk & Delivery Completion



Delivery is deemed complete once goods are unloaded at the kerbside.


Risk transfers:


  • B2C customers: Upon delivery to the kerbside
  • B2B customers: Upon dispatch



Customers are responsible for securing goods after delivery.





10. Returns, Cancellations & Refunds



All returns, cancellations, and refunds are governed by our Returns Policy, which forms part of these Terms.


Where applicable, statutory consumer rights apply.





11. Limitation of Liability



Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including for death or personal injury caused by negligence or fraud.


Subject to this:


  • We are not liable for indirect or consequential losses
  • Our total liability is limited to the value of the goods supplied
  • We are not responsible for installation errors, misuse, or failure to follow product guidance






12. Intellectual Property



All website content, including text, images, logos, and branding, remains the property of Romford Fencing Ltd.





13. Privacy & Data Protection



Personal data is processed in accordance with our Privacy Policy, which forms part of these Terms.





14. Governing Law & Jurisdiction



These Terms, the Returns Policy, and the Privacy Policy are governed by the laws of England and Wales.





15. Amendments



We reserve the right to amend these Terms at any time. The version in force at the time of order placement will apply.





Binding Agreement



By placing an order, you confirm that you have read and agreed to these Terms of Service, the Returns Policy, and the Privacy Policy.
